Thailands Marriage Equality Law to Take Effect on January 22, 2025
The Act Amending the Civil and Commercial Code (No. 24) B.E. 2567, also known as the Marriage Equality Law, has been officially published.
Key Highlights:
1. Inclusive Legal Terminology:
The terms "man" and "woman" in engagement and marriage clauses have been changed to "betrothed" and "recipient of betrothal," or simply "both persons."
2. Marriage Status:
The legal term "husband and wife" has been amended to "spouses."
These changes ensure equal legal status, rights, and obligations for all married couples, regardless of gender identity.
3. Legal Effectiveness:
The law will take effect 120 days after being published in the Royal Gazette, meaning marriage registration under the new law will be available starting January 22, 2025.
4. Legal Protections:
The law guarantees equal rights concerning marital property management, adoption rights, consent for medical treatment, and other related family legal matters.
5. Governments Role:
Relevant government agencies are tasked with raising public awareness and educating citizens on the laws civil and criminal implications. This includes clarifying marital rights and responsibilities, ensuring smooth implementation of the new legislation.
